What Changed in 2026: NJ's Intoxicating Hemp Law
New Jersey's intoxicating hemp law, P.L.2025, c.215 (signed January 12, 2026 and amended by P.L.2026, c.7), redefines hemp. Since April 13, 2026, products with more than 0.4 mg of total THC per container are no longer hemp. They're treated as cannabis, and only licensed cannabis businesses can sell them.
That covers most delta-8, delta-10, THCa flower and high-dose "hemp" gummies and vapes that used to be sold at smoke shops, gas stations and convenience stores. Online sales of hemp-derived products are also prohibited, and selling any product with detectable THC to anyone under 21 is banned.
